1. Agreement to Terms

By accessing and using the Thunder Whisper Sync website and services, you acknowledge and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you should not use our services. These terms are subject to change without notice, and your continued use constitutes acceptance of modifications.

2. Services Offered

Thunder Whisper Sync provides customized travel packages and experiences centered around Japan's cherry blossom season (hanami). Services include itinerary planning, accommodations, guided tours, meals, transportation coordination, and cultural activities. Specific inclusions vary by package and are detailed in individual package descriptions and booking confirmations.

3. Booking and Reservation

To book a hanami package, you must complete our booking form, select your preferred dates and package, and provide accurate personal information. A deposit of 30% of the total package price is required to secure your reservation. Full payment is due 60 days before your travel date. Bookings are confirmed only upon receipt of the deposit and our written confirmation.

4. Payment Terms

All prices are quoted in Japanese Yen (¥) and are subject to change if not booked within 30 days. Payment must be made via the secure payment methods offered on our website. We accept major credit cards and bank transfers. Payment processing is handled by third-party processors who comply with PCI DSS security standards. We reserve the right to decline bookings that appear fraudulent.

5. Cancellation and Refund Policy

Our cancellation policy is as follows:

• 90+ days before departure: Full refund of deposit and all payments
• 60-89 days before departure: 50% refund of deposit and payments
• 30-59 days before departure: 25% refund of payments; deposit non-refundable
• Within 30 days of departure: No refund; full payment retained

Cancellations must be submitted in writing via email to info@thunderwhispersync.com. Refunds will be processed within 14 business days. We strongly recommend travel insurance to protect against unforeseen cancellations.

6. Travel Insurance

While not mandatory, we strongly recommend comprehensive travel insurance covering trip cancellation, medical emergencies, lost baggage, and travel delays. Thunder Whisper Sync is not responsible for any losses, medical expenses, or other costs incurred due to inadequate insurance. We can assist with insurance recommendations and enrollment.

7. Changes to Itineraries

Thunder Whisper Sync reserves the right to modify itineraries based on cherry blossom bloom forecasts, weather conditions, local events, or unforeseen circumstances. Our priority is to ensure you experience peak sakura viewing. Significant changes will be communicated as soon as possible, and suitable alternatives will be offered. Minor adjustments to optimize your experience may be made without advance notice.

8. Participant Responsibilities

By booking with Thunder Whisper Sync, you agree to:

• Provide accurate, complete personal information on your booking form
• Disclose any medical conditions or physical limitations affecting your ability to participate
• Comply with all applicable laws, visa requirements, and entry regulations
• Maintain respectful behavior toward guides, fellow travelers, and local communities
• Follow safety instructions provided by guides and partners
• Arrive on time for all scheduled activities and meetings
• Participate responsibly and not engage in illegal or harmful activities

9. Health and Fitness Requirements

Some activities included in our packages involve walking, hiking, or other physical exertion. Participants must be in reasonable health and physically capable of completing the activities described in their package. If you have medical conditions, mobility limitations, or other health concerns, disclose them during booking so we can make appropriate accommodations or provide alternatives.

10. Liability and Risk Assumption

You acknowledge that travel involves inherent risks including but not limited to accidents, illness, weather, theft, and other unforeseen events. Thunder Whisper Sync, its staff, and partners are not responsible for:

• Personal injuries, illness, or death during or resulting from your travel experience
• Lost, stolen, or damaged personal belongings
• Natural disasters, weather events, or force majeure circumstances
• Delays or changes to flights, transportation, or scheduled activities
• Actions or omissions of third-party service providers (airlines, hotels, restaurants)
• Misadventures or accidents arising from your own negligence or violation of instructions

By booking, you assume all risks associated with travel and agree to release Thunder Whisper Sync from liability to the maximum extent permitted by law.

11. Age Requirements

Participants must be at least 18 years of age to book packages independently. Minors must be accompanied by a parent or legal guardian who bears full responsibility for the minor's conduct, safety, and compliance with these terms. Thunder Whisper Sync reserves the right to exclude participants who engage in dangerous, illegal, or inappropriate behavior.

12. Conduct and Code of Conduct

All participants must maintain respectful, courteous behavior toward guides, fellow travelers, local community members, and cultural sites. Prohibited behaviors include harassment, discrimination, excessive alcohol consumption, drug use, violence, or any actions that disrupt other travelers' experiences or show disrespect to Japanese culture and traditions. Thunder Whisper Sync reserves the right to exclude participants violating these standards and may terminate bookings without refund.

13. Intellectual Property

All content on the Thunder Whisper Sync website, including photographs, text, logos, designs, and graphics, is the property of Thunder Whisper Sync or licensed partners and is protected by copyright and international intellectual property laws. You may not reproduce, distribute, transmit, or display any content without explicit written permission. Personal photography for non-commercial use is permitted during experiences.

14. Visa and Travel Documentation

Participants are responsible for obtaining all necessary visas, passports, vaccinations, and travel permits required for entry into Japan and any other countries on their itinerary. Thunder Whisper Sync can provide general guidance but is not responsible for visa denials, entry restrictions, or immigration complications. We recommend checking with your embassy or consulate for current requirements at least 3 months before travel.

15. Limitation of Liability

In no event shall Thunder Whisper Sync, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising from or related to your use of our services or travel experiences. Our total liability is limited to the amount paid by you for the package.

16. Indemnification

You agree to indemnify, defend, and hold harmless Thunder Whisper Sync and all associated parties from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from your violation of these terms, your misuse of our services, your behavior during travel, or any harm you cause to others.

17. Dispute Resolution

Any disputes arising from these terms or your booking shall first be resolved through good-faith negotiation between you and Thunder Whisper Sync. If negotiation fails, disputes shall be governed by the laws of Japan and resolved through Japanese courts or mediation. Both parties agree to attempt mediation before pursuing litigation.

18. Force Majeure

Thunder Whisper Sync is not liable for failure or delay in performance under these terms due to force majeure events including but not limited to natural disasters, pandemics, war, terrorism, government actions, or other circumstances beyond reasonable control. In such events, we will make reasonable efforts to reschedule or provide alternatives.

19. Third-Party Services

Our packages include services provided by independent third parties (hotels, restaurants, transportation, guides). While we carefully select partners, we are not responsible for their conduct, performance, or any failures in service delivery. Any complaints regarding third-party services should be reported to us immediately so we can address them.

20. Accessibility and Accommodations

Thunder Whisper Sync is committed to providing accessible experiences. If you require accessibility accommodations due to disabilities, inform us during booking so we can arrange appropriate services. However, we cannot guarantee accommodation for all accessibility needs. Some remote sites or historical locations may have inherent limitations we cannot overcome.

21. Photography and Media

Thunder Whisper Sync may photograph or record video during experiences for promotional, educational, or archival purposes. By booking, you grant permission for such use unless you explicitly opt out in writing. If you do not wish to be photographed, inform your guide. We respect privacy requests and will honor opt-out preferences.

22. Modifications to Terms

These Terms of Service may be updated at any time without notice. Material changes will be posted on our website with updated "Last Modified" dates. Your continued use of our services following changes constitutes acceptance of modified terms. We encourage periodic review of these terms.

23. Severability

If any provision of these terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, removed. The remaining provisions shall continue in full force and effect.

24. Entire Agreement

These Terms of Service, along with our Privacy Policy and specific package terms, constitute the entire agreement between you and Thunder Whisper Sync regarding your booking and use of our services. Any prior agreements, understandings, or representations not included here are superseded by these terms.
